摘要
家族主义在中国文化背景下指的主要是以某一男性家长为源头所传承下来的一定范围内的亲属所构成的整体。家族主义是中国传统法律文化中非常重要的内容,结合中国传统法律重刑轻民的特征,从刑法原则、罪名、执行上可以看到家族主义的影响。家族主义能影响中国传统法律的原因主要是农业社会的经济基础、儒家文化的影响及统治者的选择。现代法治社会仍然需要继续研究家族主义对法律的影响。
In the context of Chinese culture,familism refers to the whole family formed by a certain range of relatives inherited from a male parent. Family law is a very important part of Chinese traditional legal culture. Combining with the characteristics of the traditional Chinese law,the influence of the family doctrine can be seen from the principle of criminal law,the crime and the execution.
