摘要
审判组织普遍欠缺对专业技术事实的司法认知能力,是审理日渐增多的涉及专业技术争议的诉讼案件时贯彻以审判为中心所必须解决的问题。委托司法鉴定、引入技术调查官、庭外咨询技术专家均不能提升审判组织的上述能力,对该类案件实行专家陪审是解决该问题的便捷路径,应当在人民陪审员制度改革中完善专家陪审制的顶层设计。
The judicial organization is generally lack of professional and technical fact judicial cognition ability, which is the problem we should solve when we carry out trial centered necessary in the growing cases of the lawsuit involving professional technical dispute. To delegate judicial appraisal, to introduce technology ombudsman, and to consult experts outside court cannot ascend the ability of judicial organization, implements of the expert jury for this kind of case is the convenient path to solve the problem, the expert in the people＇ s juror system reform should be perfect at the top design of the jury system.
