摘要
土地征收权是以公共利益为目的,强制获得土地所有权的国家权力。征收行为符合法定的公益目的与足额补偿的限制条件,被征收者就应当服从。国务院关于"农民对征地决定和征地补偿的确认材料作为征地报批必备材料"的规定,不仅在理论上与征收权的基本属性存在冲突,同时也缺乏实践上的可能性。这样的程序设置表面上有利于农民权利,但在实践中不但无法发挥其应有的作用,反而影响了行政效率,导致了"农民确认"程序存在一定缺陷。因此,对"农民确认"程序要进一步完善,加入听证程序,增加争议判断机制,并修改《中华人民共和国土地管理法》中的相关表述,补充相关内容,以达到真正保护被征地农民知情权、财产权等合法权利。
Land expropriation is the power of a government to take private property for public use.If the land expropriation fits the constraints on public use and the government offers adequate compensation,the farmers whose land is taken should submit to the decision.The Chinese State Council stipulated＂the farmers＇ confirm is a necessary condition for examination and approval of land expropriation＂.This statement not only conflicts with the compulsory of land expropriation,but also can not be realized.Such a procedure seems to favor the rights of farmers,but it is impossible to play a role in practice and reduces the efficiency of the government＇s administration.So the procedure of farmers＇ confirm should be further improved,aprocedure of hearing should be supplemented to set up a mechanism of dispute judgement,and some statement in the Land Management Law should be revised so as to really protect farmers＇ legal rights to know the truth and to keep their property.
