摘要
存款名义人挂失取走他人存款的行为如何定性,理论界存在很多争论。有观点认为属于民法上的不当得利,因为存款名义人与实际存款人两者之间没有任何意思表示,前者获得财产利益没有合法根据,而后者却因此遭受了存款损失,两者之间具有因果关系。也有观点认为其构成侵占罪,司机王某和实际存款人总经理之间形成了事实上的委托关系,前者将合法占有的存款变为自己所有。也有不少人认为王某构成盗窃罪,认为存款名义人违背了实际存款人的意志,将存款转移到自己占有。也有其他的观点认为是存款名义人虚构事实、隐瞒真相向银行实施了欺骗行为。而本文一改传统的视角,首先从法律关系为切入点对本案中的银行、实际存款人总经理刘某和存款名义人司机王某之间的行为进行剖析,在该前提之下,对银行存款的占有状态进行分析,来判断司机王某行为性质。本文的观点是:司机王某的行为属于民法上的不当得利,王某的行为不构成犯罪。
Savings deposits in the name of report the loss of my people take others how qualitative behavior,the theoretical circle there are a lot of controversy.Have idea that belong to the unjust enrichment of civil law,because between people and the actual depositors deposit name without any meaning,said the former get property interest had no legal basis,and therefore the latter suffered deposit losses,a causal relationship between the two.Also has a view its constitute embezzlement,driver Wang and actual depositors formed in fact clientage between general manager,the former seized legal deposit into all myself.There are many people think that Wang constitute theft,think people in defiance of the will of the actual depositors deposit name,transfer the deposit to their possession.There are other view is deposit in the name of fictional facts and conceal the truth to the bank to cheating.And change traditional perspective,this article first from the legal relations as the breakthrough point of this case in the bank,the actual bank depositors general manager and analyzes the behavior of people in the name of the driver Wang between in the,under the premise,possession of bank deposit status were analyzed,and to determine the driver Wang behavior nature.The idea of this article is:the behavior of the driver Wang belongs to the unjust enrichment of civil law,Wang conduct does not constitute a crime.
