摘要
秦汉时期,国家对地方司法属吏,如令史、狱史、卒史等的考核升黜,制定了严格的制度规范。他们不仅能够通过积累"功劳"的一般途径获得晋升,也能因为侦破案件的特殊成绩而取得升迁机会。同时,司法属吏在考课中失利或在履职中出现违法犯罪行为则会引发职务罢黜。秦汉地方司法属吏升黜机制的法律构建,国家对司法属吏升黜权的监控,属吏升黜与选官制度的结合以及由此形成的多重官僚监控机制,对完善当代中国基层司法公务员的管理监控制度具有重要的借鉴价值。
On condition that observation all the complicated process of the address issues from search in investigation to execution of punishment,we would detect that the grassroots official staffs,such as Yu Shi,Ling Shi and Zu Shi playing important roles in the judicial activities.The bamboo slips of Qin and Han dynasties has intuitively displayed the official staffs could get promotions both by accumulation of credit and speliing award of solving criminal cases.Similarly,official staffs loss in the assessment or in illegal negligent behavior also lead to the fate of the deposed. The legal system of the promotion and recall system for the official staffs of Qin and Han Dynasties,and its supervision system have important reference value for the perfection of China civil servant management monitoring system.
