摘要
新修订的《立法法》赋予了设区的市以立法权,此次"赋权"逻辑可以概括为是基层治理语境下的一种表达。作为现代法治建设中的秩序维系的需要,设区的市立法权的获立能有效地应对地区治理困境,为权力正确运行提供约束力和制度保证。而立法能力是设区的市行使立法权的前提,同时也是设区的市做好立法工作的核心和关键。由此要求设区的市立法能力建设要加快进程,通过优化立法资源配置,明确立法主导能力,提升立法项目选择能力,增强法规草案起草能力,完善立法后评估能力等举措,迅速提升立法能力与水平,为设区的市立良法、施善法打下坚实基础。
The newly revised ＂legislation law＂ has given the city of the region the legislative power, and the ＂empowerment＂ logic can be summed up as an expression in the context of grass-roots governance. The legislative a- bility is the premise for the municipality to exercise the legislative power, and it is also the core and key of the legis- lation of the municipality. The construction of local legislation ability in the district as the need of order maintenance in the modern legal construction can effectively cope with the plight of regional governance. The legislation should be the important precondition and foundation of reality and carefully grasp the local legislative quality and enhance the demands of the times to carry out the municipal legislative work, for the exercise of power to provide the institutional guarantee and restriction right, strengthen the districts and local legislative capacity building has a profound realistic demand. Located in the city district local legislation the ability to obtain a deeper meaning of the value proposition in the new demand, through optimizing the allocation of legislative resources, improve the city to enhance the ability of scientific legislation leading legislative project ability, strengthen the taws to draft ability, strengthen the assessment ability and other measures, a solid foundation for better legislation .
