摘要
随着我国经济从粗放型向集约型、从简单分工向复杂分工的转变,传统凯恩斯式的需求侧短期干预已经无法使我国迅速摆脱国内外经济增长双重疲软的境况,在短期内实现经济的V字型反弹。我国经济发展模式亟需从需求侧拉动的"单腿支撑"向供给侧为主,适度扩大需求侧的"双腿走路"迈进。当前中央对供给侧改革的多项部署,对缘于市场与政府双重失灵之校正和寻求政府与市场博弈均衡解的经济法而言无疑是一个重大的挑战。需要经济法主体制度通过制度性变革来推动政府简政放权、转变职能,明确社会中间层主体的独立性,完善产权、社会分配等制度来保证市场主体的权益。需要经济法宏观调控制度从具体的财政法、金融法、产业政策法和发展规划法出发,推动稳定的宏观经济环境之形成。需要经济法市场规制制度通过完善产品质量与食品安全、消费者权益保护和市场竞争法律体系来建构宽松的投资经营环境,保障市场在资源配置中的基础性地位。
Along with the process of our country＇s economy development mode changing from extensive to intensive, simple division to the complex, the traditional Keynesian short-term intervention in demand side can no longer help our country rapidly get rid of the double weakness dilemma that our country＇ s economy is slack both in and out of the country, let alone to achieve the economic V-rebound in the short term. China＇s economic development mode needs to be pulled from the demand side ＂single leg support＂ to the supply side which moderately expand demand side like a man walking on two legs. Contemporary reform of the central government to the supply side pose a major challenge to the economic law which stem from rectification of the double failure of market and government and to seek a balanced outcome of the game between the government and the market. A structural reform of Economic law subject system is needed to push our government to simplify administrative procedures, delegate power to lower lev- els, achieve the transformation of government authority, define the independence of the subject of social intermediar- y, improve the system of property rights and social distribution ensuring the rights and interests of market partici- pants. We need the macroeconomic regulation system to promote the formation of through the specific laws such as fiscal law, financial law, industrial policy law a stable macroeconomic environment and development planning law. Also needed is the regulation system of economic law to foster a loose investment and management environment and to bolster the fundamental position of the market in the process of resource allocation via perfecting the legal system to protect product quality, food safety, protection of the rights and interests of consumers and the market competition.
