摘要
1971年《蒙特利尔公约》要求各国将传送虚假民航情报罪规定为国内法中的犯罪并予以严惩。公约设置此罪的目的是为了保护航空器飞行安全,因为虚假民航情报可以"使载有大批旅客的飞机变更其原定航线,或者迫使其在非预定地点降落,构成对飞机安全的灾难"。随着航空运输业的发展和网络电子信息技术在航空运输领域的广泛应用,此类行为所涉虚假民航情报的范围也发生着变化,不仅包括航空器遇险的假情报,还包括直接危害航空器飞行安全的虚假服务情报。考察域外不同国家和地区对传送虚假民航情报罪的转化立法,建议我国刑法在保留编造、故意传播虚假恐怖信息罪的同时,在危害公共安全罪章中增设故意传送虚假交通信息罪的危险犯和实害犯,并设置传送虚假交通信息行为的过失犯罪,形成保护交通运输安全的严密刑事法网,实现对传送虚假民航情报罪的全面转化。
The purpose of enacting the crime of communicating false civil aviation information in Montreal Convention of 1971 is to protect the flight safety. False information includes not only message which says the aircraft is in distress but also the false service information about flight＇ s safety. Now, in the world, a plenty of countries and regions have adding legal provisions to prohibit such behaviors in their criminal law in accordance with their own legal system, setting the offense of act, the offense of dangerous act, the offense of actual damage as well as the intentional offense and negligent offense. Besides this, the range of legal punishment varies wildly from country to country. The crime of spreading false aviation terrorist information in our criminal law is the legislative transformation of the crime in this convention. However, the transformation is not comprehensive. While retaining the crime of ours, we should stipulate the crime of communicating false information in Chapter II of specific provisions of our criminal law to protect the transportation security and achieve a comprehensive convergence with the Convention.
