摘要
在风险社会的背景下,发展与冲突并存,刑法作为最有力的社会风险管控手段,通过发挥其入罪功能实现保障社会安定的目的.在刑法立法中,较为典型的表现就是"以危险方法危害公共安全罪"的适用.由于该罪没有明确的、可作为判断是否入罪的记述性罪状描述,因此其规定属于一种非常特殊的"空白罪状+堵漏条款"模式,①空白罪状导致法官在本罪客观方面的认定上极具不确定性,堵漏条款导致本罪在适用上极具包容性,加之相关司法解释的推波助澜、公众舆论的压力,导致本罪在认定上出现混乱以及扩张适用的趋势.因此,有必要对"其他危险方法"进行合理界定,厘清本罪的入罪标准.只有对本罪进行限制适用,才能保障司法符合立法原意,才能实现不滥用刑罚权、保障犯罪人权利,做到罪责刑相适应,更好地发挥刑法有效惩治犯罪人的功能.
Under the background of risk society,development and conflict coexist.Criminal law,as the most powerful means of social risk control,realizes the purpose of ensuring social stability by giving full play to its criminal function.In the criminal law legislation,the more typical manifestation is the application of the crime of endangering public safety by dangerous method.Because the crime does not have a clear and descriptive description of the crime,its provisions belong to a very special model of"blank count and plugging clause",which leads to the uncertainty of the judge's objective determination of the crime.The plugging clause leads to the application of the crime is very inclusive,coupled with the related judicial interpretation,public opinion pressure,resulting in confusion in the identification of the crime and the trend of expansion of the application.Based on this,it is necessary to define"other dangerous methods"reasonably and clarify the standard of crime.Only by restricting the application of this crime can we ensure that the judiciary conforms to the original intention of the legislation,can we not abuse the right of punishment,guarantee the right of the offender,adapt the crime and punishment,and give full play to the function of the criminal law to punish the offender effectively.
