摘要
随着国家财政科研投入在"量"上的不断增长,对各类科研基金资助体系的结构、效益和公平性等"质"的方面的评价也越发重要。现有研究多关注国家科研资助的经济属性,主要从投入—产出视角对经费使用效益进行分析,而相对忽视这一国家行政行为的法治属性,对其公平性和权利保障价值重视不够。本文基于法治建设的一般理论,借用法治评估的相关原理,在深入探讨国家科研资助的权利保障核心价值的基础上,选取价值性评价进路和定性评价方法,从权利保障维度提取了法定性、组织性、公正性、专业性、平等性、自主性等关键指标,构建了对国家科研基金的评价体系,并以国家社科基金评价为案例对其有效性进行一定验证。国家设立的科研基金对于现代科学研究不可或缺,我国宪法明确规定了公民的科学研究权利,以及国家对科学研究予以鼓励和帮助的义务,在"权利导向"的现代法治国家,国家科研资助的根本价值就是保障公民权利。在法治政府建设进程中,区域性法治评估和司法等专项评估火热开展,与此同时,从法治的本质和内涵出发,对某一具体的国家职能履行情况进行考察和评价也具有一定的理论和实践意义。
bWith the rapid growth in the quantity of financial input into scientific research,it is becoming increasingly important to assess the quality of Government Research Funding operations. Therefore a good deal of attention has been drawn to the structure,efficiency and fairness involved in financing research projects.However more previous studies have focused on the analysis of the economic efficiency of financialinvestment in the research, but, to a considerable degree, the legal essence ol this administrative act is neglected ,which has thus led to the notable absence ol studies on such issues as equality and rights protection function in the matter.It is believed that in the modern law-ruling society, based on the general theory ol the ruleby law, the fundamental value ol government research funding operations must be the guarantee ol civil rights enjoyed by the citizens. Bearing this in mind,this paper,applying the relative principles ol assessment ol the rule by law, performs an assessment based on value and qualitative evaluations ol government research lunding.On the dimension ol civil rights protection, the study suggests that the government research lunding operations can be investigated interms ol the three aspects ol premise guarantee, process guarantee and result guarantee,while the key evaluation indexes include legislation,mechanism,procedure,prolession,equality and lreedom.The validity ol this assessment system gets lurther verilied in the process ol its application to the lundingoperations performed by the National Social Science Foundation ol China.The analysis ol NSSFC lundingactivities has produced lindings as below.The investment guarantee ol national social science foundation has been well implemented in China; The relevant legislation needs to be lurther strengthened and the organizational structure and institutional mechanisms need to be lurther improved; The management systems and procedures are relatively complete,but the participation and transparency need to b
