摘要
互联网创新发展带来了社会经济关系变化,其表现出的尊重个体需求、跨界融合、结构创新、开放共享等特性成为法治研究的主要基点,契合了经济法特征,需要经济法治予以必要的回应。互联网创新突破了现有法律制度调整的社会经济关系范围、开拓了法律适用的新领域、改变了以国家法律为主体的调整模式。互联网创新发展中的经济法治回应当从两方面入手:一方面,宏观调控法律制度是实现经济新常态的重要保障,应根据互联网创新对产业结构、产业模式的影响和改变,重新构建包容与开放型的宏观调控法律制度,并适时制定《计划调控法》。另一方面,应完善市场秩序相关法律制度,包括针对新型市场交易关系建立多元化的规范体系,基于信息优势对互联网中介平台的法律规制作出顶层设计,针对金融领域的创新发展建立以风险规制为核心的治理机制。
The internet innovation development has been bringing the changes of the social and economic relationships,which includes the features of the esteem for individual requirement,the cross-boundary integration,structure innovation,and opening-up sharing. These features are the main base points suitable to features of the economic legal governance,needing its response. In the innovation of internet,the scope of socio-economic relations by legal regulation is magnified and frontiers of application of law are exploited and the national law playing the dominant role is changed. The response of economic legal governance includes two hands:macro-control of the legal system is the important guarantee to realize the economic new normal,so the macro-control of legal system with containment and open should be reestablished according to the influence and changes of the internet innovation on the industrial structure and mode,and the 'Planed Control Law 'be timely legislated; the relevant legal system for market order should be improved,including the establishment of the diversified regulation system,the top designing for legal regulation of the intermediary platform of the internet based on the information advantage,as well as the establishment of the governance mechanism oriented to the risk regulation in financial market.
