摘要
工会依法维权具有法律和政策依据,但当前情况下,市、区、县总工会面临帮助职工依法维权的困境,在解决问题的过程中,以法律为依据,因地制宜,根据具体情况摸索出与案情、省情相一致的维权模式。取得维权成功的方式包括依法维权、依理维权、联动维权、联合维权、工会领导负责维权、党委和政府支持维权和被动维权等,这些方式属于调解,不属于协商、仲裁和诉讼。市、区、县总工会的维权与其他类型工会的维权相比,具有自身优势,但也有可能转化为弊端。
There are laws to abide by for the trade union' s law-based rights protection. However, to date the federation of trade unions of City, District and County has been confronted with the plight of law-based rights protection. In the process of solving problems, in accordance with laws, in line with local conditions and in terms of specific circumstances, a right-protection pattern that is suitable to the details of a case and provincial conditions would be found out. Ways to protect rights successfully include rights protection according to laws, rights protection according truths, coordinated rights protection, joint rights protection, in charge of rights protection by leaders of the trade union, supporting rights protection by the Party committee and government and the passive rights protection, which belong to conciliation rather than negotiation, arbitration and proceeding, the federation of trade unions of City, District and County' s rights protection is with its own advantages, which could transform into disadvantages, comparing with other trade unions' rights protection.
