摘要
我国现代市场经济中的招投标制度是从西方国家引进的一种资源配置制度和交易方式。实践中,由于政府监管部门过多强调本行业特点和部门利益,招投标分行业监管体制"九龙治水"格局影响了行政监督的效果,造成了招投标腐败问题多发和诸多监管困境。本文通过分析现行体制矛盾和招投标腐败的制度诱因,提出要遵循制度变迁规律,构建统一监管平台提升招投标行政监督效率,创新科技手段为公平公正交易提供技术保障,从制度创新和制度执行两个层面去考虑,有效解决公共采购政策实施中的规范化执行问题和更深层的心理预期问题。
The existing bidding system in China＇s modern market economy is a resource allocation system and trading way introduced from western countries. In practice, the supervision department emphasizes too much on characteristics of industry and profit of department, the ＂Nine dragons governing water＂ pattern of separate industry supervision system for bidding influences the effectiveness of administrative supervision, leads to multiple bidding corruptions and many regulatory dilemmas. This paper analyzes current system＇s contradiction and system incentives of bidding corruption, proposes to follow the law of institutional change, to build an unified supervision platform to improve the efficiency of the administrative supervision for bidding, to innovate technology to provide technical support for fair trade, to consider the two situations of the institutional innovation and implementation, to effectively solve standardized implementation issues and deeper anticipated problems during the practice of public procurement policies.
