摘要
为了有效防止传统体育非遗在传承的过程中流失或消亡,应当加强对体育非遗的法律保护。可以选择著作权和专利权对我国传统体育非遗进行静态性保护,同时选择商标权对传统体育非遗进行动态性的保护,即对其开发利用着手保护。为使我国的传统体育非遗能够获得法律的有效保护,应当加快专项立法和地方立法,同时还要逐步完善与体育法相配套的法规。
In order to prevent the loss and extinction of traditional sports intangible cultural heritage effectively in the process of inheriting,it is deserved to strengthen the legal protection for the heritage. Copyright and patent rights can be used to for the static protection of the heritage,and at the same time,trademark rights for the dynamic protection,i. e. starting the protection for its development and utilization. To make the traditional sports intangible cultural heritage in China have access to effective legal protection,it is advised to speed up the specific legislation and local legislation,and gradually improve the supporting sports laws and regulations.
