摘要
生态环境损害政府索赔制度旨在解决环境保护"公地悲剧"引发的"企业污染、政府买单"困局,但也与行政机关可以责令消除、修复环境并适用代履行的规定发生矛盾,故政府索赔应限缩到生态环境无法修复、因而无法适用上述规定的情形。从法律的体系性和逻辑的一致性来看,宜在未来修改法律时进一步增加不能修复时责令赔偿的规定,并通过行政公益诉讼监督政府履行监管职责。
The government claim for ecological damage aims to solve the dilemma of " polluted by the enterprises,paid by the government" which caused by the tragedy of commons,however,this approach also raises contradictions with environmental regulation,as current laws have already set out a series of rules to rectify the illegal activities and relieve the ecological damage. As a result,the governmental claim shall be limited to circumstances which cannot be solved by administrative procedures. A better way is to directly order the offenders compensating the ecological damage in administrative laws,and allow competent organs or organizations to supervise the environmental regulation through administrative public interest litigations.
