摘要
2016年2月,国家发改委发布的《横向垄断协议案件宽大制度适用指南(征求意见稿)》,对我国《反垄断法》中宽大制度的具体适用进行了细化,大大提高了反垄断执法的透明度,但是并未引入附加宽大机制。附加宽大通过给予违法者附加的优惠,弥补了传统宽大制度自身的缺陷,在节约执法资源的同时,有利于更好的发现和查处卡特尔行为。在卡特尔行为频发的背景下,有必要在传统宽大制度的基础上,引入附加宽大机制,吸引在多个市场上达成垄断协议的同一违法者与反垄断执法机构合作,充分发挥宽大政策的功能优势。
In February 2016, National Development and Reform Commission Issued "horizontal monopoly agreement case leniency system application guide (draft)", it has carried on the elaboration of leniency policy in our anti-monopoly law and im- proved the transparency of the anti-monopoly law enforcement ,but it does not intro- duce leniency plus. By giving cartelist additional reduction of sanctions, leniency plus make up the defects of the traditional leniency policy, it not only save en- forcement resources but also help discover and punish cartels. Under the background of frequent cartel behavior, it is necessary to introduce leniency plus on the basis of leniency policy. By appealing cartelist to cooperate with antitrust agency with regard to operation of another cartel on an unrelated market, it will increase the function of leniency policy.
