摘要
为保护具有世界声誉的杂技艺术,我国《著作权法》将"杂技艺术作品"作为作品的一类,并在第三次《著作权法》修改过程中将其定义补充完善。然而,"杂技艺术作品"的规定在学界一直存在争议。因此,探究"杂技艺术作品"规定的合理性具有重要意义。实际上,根据著作权法基本理论探究可以发现,"杂技艺术作品"的规定并无必要,同时,"杂技艺术作品"规定十余年来在司法实践中并未充分发挥保护我国具有世界声誉的杂技艺术的作用。因此,应当删除"杂技艺术作品"的规定,同时,扩大关于表演者的范围,用表演者权保护杂技、魔术、马戏的表演者,从而在著作权法意义上为其提供合理的保护。
To protect the acrobatics with a world reputation, the "Acrobatic Art Works" was added in the 2001 Copyright Law. Its definition was further revised in the third revision of, the Copyright Law. However, there have always been disputes on provisions of "Acrobatic Art Works", which makes it necessary to discuss the rationality of these provisions. Actually, acrobatics, magic and circus don't constitute works. What's more, the provisions of "Acrobatic Art Works" doesn't have a positive effect on protecting acrobatics, magic and circus. As a consequence, the protection for acrobatics, magic and circus should be changed. On the one hand, these provisions should be deleted. On the contrary, the definition of "performer" should be extended to include those performing acrobatics, magic and circus.
