摘要
成立监察委员会不仅涉及修宪,而且在修宪之后还需立法,除了将《行政监察法》改为《国家监察法》外,还应制定《监察委员会组织法》。这两部法律性质不同,一个是监察组织体制,一个是监察行为规范,二者难以相互替代。各中央级国家机构基本上都有相应的组织法,监察机关由原来的监察部上升到与"一府两院"平行的监察委员会之后,也应该有自己的组织法。该组织法应是宪法相关规定的细化,而不宜重复宪法的有关内容。
The establishment of supervision commission not only asks for the amending of the Constitution, but also for relevant legislations after such amendment is made. Correspondingly, besides converting Law on Administrative Supervision in- to Law on State Supervision, it is also necessary to make a Organization Law of Supervision Commission. These two laws are different to each other in its legal nature. The Law on State Supervision regulating the supervision acts while the Organization Law regulating its organization and institution. Both of them are irreplaceable. Since every central state organ has its own or- ganization law, it seems that it is necessary to make a specific organization law for the supervision commission after the Minis- try of Supervision is elevated to the same hierarchy as the State Council, the Supreme People＇s Court and the Supreme People＇ s Proscuratorates. Such a law should be the concretization of concerned constitution norms but not playing of parrot.
