摘要
平台经济的日渐兴起,尤其是"互联网+"应用的常态化,使商业舞弊行为在平台语境下呈现新的态势,并对平台经济的安全和社会诚信体系建设造成负面影响。为提升治理的有效性,本文首先对平台经济视域下商业舞弊行为的内涵、表现与特征进行了解构,指出了平台型商业舞弊行为的圈层性、虚拟性、复杂性和危害性;在明确问题的基础上,以协同治理理念为指导,从"主体协同"和"路径协同"两个维度重构了商业舞弊行为的治理框架,形成了"平台(自治)—政府(法治)—社会(共治)"的多元主体治理范式;最后,从路径创新的视角思考了商业舞弊行为的治理对策,提出以制度治理为依据,搭建有约束力的制度体系;以组织治理为载体,形成有控制力的组织体系;以技术治理为手段,形成有监督力的技术体系;以文化治理为保障,形成有自制力的文化体系。
With the rising of platform economy,especially the wide application of Internet plus,commercial fraud isshowing a new trend,and having a negative impact on the security of platform economy and social credit system construction. To enhance the effectiveness of governance,this article firstly deconstructs the connotation,performance andcharacteristics of commercial fraud and points out the circle,virtuality,complexity and perniciousness of commercialfraud on platform. On the basis of clarifying the problem,it takes the concept of collaborative governance as guide,andreconstructs the governance framework of commercial fraud from two dimensions of subject coordination and path coordination,and forms a multi-subject governance paradigm including platform （self-governance）- government （rule oflaw）-society （shared governance ）. Finally,it puts forward some countermeasures from the perspective of path innovationsuch as building a binding system with governance system as the foundation,forming an organizational system withcontrolling force with organizational governance as the carrier,establishing a supervised technical system with technicalgovernance as the means and forming a self-controlling cultural system with cultural governance as the guarantee.
