摘要
提高专利质量的源头在申请入口,遍布全国的民间发明人,面广量大,其中绝大多数是集发明人、专利文件撰写人、申请人等多重身份于一体。目前众多个人和一部分中小企业申请的发明专利项目起点比较低,质量不高。由于这类专利数量较多,从而拉低了全国整体的专利质量水平。在我国从专利大国向专利强国跨越的征程中,重要抓手之一就是要提高广大发明人独自申请专利的质量。本文分析了他们专利质量存在的问题和原因,从如何提高他们的知识产权水平、发明创新能力、如何立足市场和把握技术发展方向去选择发明课题,以及如何提升他们的专利申请业务能力等方面进行了探讨。提出一些有针对性的、具体可行的措施出来,为他们在今后能够创造出更多高质量的专利打好基础。
The key to improve the quality of patent is enhancing inventors＇ professional standards. Civil inventors through out the country are of large number, but most of them create the inventions, as well as draft patent application documents. At present, the starting point of patent application in most individuals and some small and medium enterprises is relatively low, and the quality of their patents is also generally low. However, the amount of those patents is huge. Consequently, the overall patent quality throughout the country is pulled down. In transforming from patent big state to patent strong state, improving the patent quality of those inventors who apply for patent all by oneself is a very important solution. This paper analyzes problems and causes of their patents＇ low quality, and gives solutions from strengthening their intellectual property level, improving invention and innovation ability and selecting topics based on the market and new technology development direction. Specific and concrete solutions are also given to lay a solid foundation for them to create more high-quality patents in the future.
