摘要
研究目的:归纳分析2016年国内外土地管理领域的研究进展,展望研究趋势。研究方法:文献统计法。研究结果:2016年土地管理领域国外研究侧重于土地制度改革及其所产生的政治、经济、生态效应,土地法律与政策的作用效力及效应,土地权属与登记等方面;国内研究则更多关注农村土地制度改革、不动产登记成果整合应用、自然资源资产管理理论及成果应用、土地市场监管与土地财政影响、"三权分置"法律关系界定、集体土地所有权立法及集体成员资格界定、土地用途管制与耕地保护制度等相关问题。研究结论:2016年土地管理领域在不动产登记与自然资源资产管理、土地市场监管与调控以及土地用途管制方面的研究有所进展;2017年将重点关注土地管理制度改革、不动产统一登记制度的推进与完善、自然资源资产管理体制建设、土地及房地产市场调控,乃至农村土地市场的管理与调控、土地法律体系改革等方面。
The purpose of this study is to analyze the research progress of land management in China and overseas in 2016, as well as to present the future trend of the research. The method employed is literature review. The results show that the focuses of the land management research abroad in 2016 include the land system reform and its political, economic and ecological effects, the role of land laws and policies and their effects, land ownership and registration and so on. The domestic studies pay more attention to the following aspects： rural land system reform, the integration and application of real estate registration, theoretical research on natural resource asset management and its application, land market supervision and the impacts of land finance, the definition of legal relationship regarding ＂Tripartite rural land entitlement system＂, the legislation of collective land ownership and the definition of collective membership; land use control and farmland protection system and so on. In conclusion, in 2016, in the field of land management, the new progress was made in the topics including real estate registration and natural resource asset management, land market regulation and control, and land use control. In 2017, we will focus on land management system reform, construction and improvement of the real estate unified registration, natural resource assets management system construction, industrial land market reform and rural land market regulation, and land legal system construction.
