摘要
警察职责与警察义务是警察法学上的两个基本概念,二者既有密切联系,又有明显区别。警察义务包括警察组织的义务和警察人员的义务,警察职责属于警察组织的义务。我国《人民警察法》没有区分警察组织的义务与警察人员的义务,实践中经常发生警察角色冲突问题。构建和谐警民关系,需要适用警察公共原则和紧急性原则来区分警察组织的义务与警察人员的义务。为此,要修改《人民警察法》的相关内容,删除该法第21条的规定,明确规定警察的服务职责包括危难救助、保管遗失物和无人认领的财物、在紧急情况下辅助解决民事争执等。
The police duty and the police obligation are two basic concepts in the police law. Both concepts not only have close connection, but also have obvious difference. The police obligations include the obligation of police organization and the obligation of the policeman, and the police duty belongs to the obligation of police organization. In China, ＂the people＇s police law＂ did not distin- guish the obligations of police organization and of policeman, leading to the police role conflicts in practice. To building harmonious re- lationship between the police and the people, we need to apply the police commonality principle and urgency principle to distinguish the obligation of police organization and of policemen. Therefore, we need to change the related content in ＂the people＇s police law＂, de- lete the provisions of article 21, make it clear that police service duties include crisis rescue, keeping lost and unclaimed property, and assisting to solve civil disputes in case of an emergency, and so on.
