摘要
公正是孔子思想中的隐问题隐概念,即虽然孔子没有直接使用公正概念以论说问题,但在其思想中却含有丰富的公正意蕴。考察孔子的公正思想,不应仅是简单地概念比附或释义,也不应随意扩大公正的视阈范围,而当以公正之实质为主线,加以梳理和提炼,否则就失去了中西思想对话的可能,也不利于中国传统公正思想的传承。通过对公正思想实质的分析可见,"仁"是孔子思想中的最高道德原则,"义"是基本道德原则,"礼"是从属于仁义的外在制度规范,而公正则是从属于"仁"和"义"的一种具体道德原则,其基本要求通过"中"和"正"表现出来,以最终达到"和"的理想目标。
Justice is the implicit concept of implicit problem in Confucius thought, namely although Confucius didn't directly use the concept of justice theory to talk about problems, including justice implication in its thought.Therefore, investigation of Confucius's justice thought, not only giving a simple concept of analogy or interpretation and it should not be enlarged just from the perspective of range. We should consider the essence of justice as the main line, to comb and refine. Otherwise, it may lose the possibility of dialogue between Chinese and Western ideas, and it is not conductive to the transmission of traditional Chinese justice. Though the analysis of the essence of justice, "Ren" is the highest moral principle of Confucius thought, "Yi" is the principle of morality and "Li" is from the external institution belongs to "Ren" and "Yi". And justice is from "Ren" and "Yi" of a specific moral principles, its basic requirements can be shown by "Zhong" and "Zheng", in order to achieve the ideal goal "He".
