摘要
仁、义不仅是儒家伦理的基本概念,同时具有法哲学意义上针对于礼的正当性意谓。但对于法律正当性而言,仁、义的概念需要区分其相关含义。立基于礼的实在性而言,仁义的正当性含义表现为如下方面:第一,正当法理论存在于仁与公义的普遍正义观念当中,仁强调了人人平等的仁学主张,强调了为仁由己的人格独立性。第二,作为制度礼义的义强调了制度正义,它既体现在礼的制度中,也体现出礼义需要外在规制与协调。第三,作为裁断合宜的义,指征了司法领域内的行为判断标准。由此展示了法律正当性的多维视域。
Benevolence and righteousness are not only the basic concepts of Confucian ethics,but also have the meaning of legitimacy in the sense of philosophy of law.But for the legitimacy of law,the concepts of benevolence and righteousness need to distinguish their relevant meanings.Based on the reality of positive law,the legitimacy of benevolence and righteousness is shown in the following aspects.First,the theory of just law exists in the concept of universal justice of benevolence and justice.Benevolence emphasizes the equality of all people and the independence of personality.Secondly,as the meaning of the system etiquette,it emphasizes the system justice,which is embodied in the system of the etiquette as well as the need for external regulation and coordination.Third,as a proper judgment,it refers to the standards of behavior judgment in the judicial field.This shows the multi-dimensional perspective of legal legitimacy.
