摘要
本文从外观设计相近似性的判断方法出发,分析了其中的现存问题,并结合司法实践中的相关判例,论述了引入"设计空间"的必要性。本文亦论述了制约"设计空间"的因素,并在此基础上探讨了外观设计相近似性判断方法的重构设想。
The paper begins with a restatement of the method for determining the similarity of industrial design, analyzes existing problems, and presents the necessity of the concept＂ design freedom＂. The paper also discusses the factors constraining design freedom, and proposes a reconstructed method for determining design similarity.
