外观设计“富有美感”的法律问题探究 被引量:8

摘要 外观设计需具备"富有美感"要求已被我国乃至世界许多国家所认可。由于"富有美感"的概念过于主观,使其在实际应用过程中常常被架空,降低了其标准,进而出现了只要产品"不丑"即可获得外观设计专利之现象的出现。为提升我国外观设计的整体水平,需坚持分类判断原则和采用一般消费者视角判断外观设计是否"富有美感"。在实际审查过程中,将"富有美感"解释为"富有装饰性",并不断完善外观设计图片的提交形式,使之更具可操作性。 Now, every country including China claims that the appearance design must accord with the standard of "aesthetically appealing". However, the definition of "aesthetically appealing" is too subjective that it aggravates the difficulty when experts decide whether to give the people who applies for the right of design patent, and because of this, the norm was lowered, only if the product is not clown, it's designer would have the right of design patent. In order to raise the level of our country's appearance design, we should judge the "aesthetically appealing" from the angle of classification and consumers. When reviewing the product, we can change the "aesthetically appealing" into "ornamental" and perfect the way of submit the picture of appearance design, in order to make it be more operational.
