摘要
代孕的出现给不孕症家庭带来了新的希望,但同时传统伦理观念的束缚、法律规范的缺位又使他面临一系列的挑战,完善代孕的法律规制,使其趋利避害、有效应用,已经迫在眉睫。通过对代孕所面临的伦理和法律问题的分析,论述其有限适度适用的合理性,并从代孕的适用主体、代孕双方的权利义务、代孕技术的适用监管等方面提出完善建议,有利于实现其合法规范有序运行,真正发挥其价值所在。
The development of surrogate brings infertility family new hope, but at the same time the bondage of traditional ethics, the absence of legal norms makes infertility family face a series of challenges. It is of great importance to improve the legal regulating of the surrogate, draw on advantages and avoiding disadvantages and make effective use of relevant law. By analyzing of the ethical and legal problems of surrogaey, the author of this paper discusses the rationality of its limited moderate application, and gives suggestions for the applicable subject of the surrogate technology, the rights and obligations of the two sides, the regulation of the surrogate technology and so on. It is helpful to realize the orderly operation of the legal norms and really play its role.
