摘要
我国目前禁止代孕的规定只停留在政府部门规章层面,实际作用有限。面对日益频繁的非法买卖卵子、出租子宫代孕等公开或地下交易活动,亟待通过立法从源头上进行遏制。文章以"局部代孕"的法律监控为视角,从分析代孕活动现状和"局部代孕"基本特征与性质等问题入手,简要分析国外和我国港台地区的立法经验,并对我国代孕问题的立法现状和主要学术观点进行梳理,提出运用法律规制势在必行,立法应当禁止"局部代孕"的主张,并论证了所提主张的法理依据,最终提出了规制"局部代孕"的立法建议。
China＇s current regulations on prohibiting surrogacy only stay in the government sector level whose practical effect is limited. In face of such open or secret trading activities as increasingly frequent illegal trade of eggs, surrogacy by uterus rental, it is urgent to curb the source with the adoption of legislation. In this article from lhe perspective of the legal control of the ＂partial surrogacy＂, from the analysis of the status of surrogacy activities and basic features and properties of ＂partial surrogacy＂, the author analyzed briefly on the legislative experience of foreign countries and Hong Kong and Taiwan, combed the present situation on legislation of China＇s surrogacy and academic points of view, and advocated the legislation to ban the partial surrogacy and demonstrated the legal ba- sis. Eventually the author proposed legislative proposals to regulate ＂partial surrogacy＂.
