摘要
[目的/意义]俄罗斯联邦已经形成了以宪法为立法依据,以安全法为立法基础,以若干纲领性文件为立法的政策指导和理论依托,以情报领导机构和情报机构法律、法规及规章为立法支撑的情报立法体系。认真研究并吸收俄罗斯情报立法的经验,有助于引导我国科学制定情报立法规划,把握立法的完整性,完善情报安全立法框架。[方法/过程]通过研究俄罗斯联邦建国之后颁布的各项情报法律法规,梳理了俄联邦情报立法的历程及结构体系,并对其主要内容和功能做出了评析。[结果/结论]提出了有关情报立法的相关建议,为中国进行情报立法提供了启示,有助于促进中国情报法制建设。
[ Purpose/Significance ] The Russian Federation has formed an intelligence legislation system with the Constitution as the legislative basis,the Security Law as the legislative framework, a number of programmatic documents as the legislative policy guidelines and theoretical basis ,and a number of regulatory documents of the intelligence agencies of various levels as the legislative support. Carefully studying and absorbing the experience of Russian intelligence legislation will help guide the scientific development of information legislation, grasp the integrity of legislation and improve the legislative framework of intelligence security in China. [ Method/Process ] Through the study of the information laws and regulations promulgated after the founding of the Russian Federation, the course and structure of the information legislation of Russian Federation are sorted out, the main contents and functions of it are analyzed and assessed, and suggestions on information legislation are given. [ Results/Conclusion] The research and summarization of the information legislation in the Russian Federation provide enlightenment for China＇s information legislation ,and help to promote the information legal system construction of China.
