摘要
我国农村政策扶贫在取得巨大成就的同时,也面临着诸多问题,迫切需要以法律手段来规范扶贫中的各项行为。政策法律化本身也是一种贫困治理机制创新。建立起以法律为主导的扶贫体系,运用法律的规范、导向、保护、制约等功能可以有效地规范扶贫中的各项行为。良好法律功能的实现不仅需要强大的法律制度设计能力,还需要在执行过程中合理发挥政策的作用,政策扶贫是法律扶贫的有益补充。
China＇s rural poverty alleviation policy has made great achievements, but also faced with many problems, it is an urgent need for legal means to regulate the behavior of poverty alleviation. Policy legalization itself is a kind of innovation of poverty governance mechanism. To establish a legal system of poverty alleviation that we need to use legal norms, guidance, protection, control and other functions which can effectively regulate the behavior of poverty alleviation. The realization of good legal function not only needs a strong legal system design ability, but also needs to play the role of policy in the implementation process. Policy of poverty alleviation is a useful supplement to the poverty alleviation through legal means.
