摘要
为保障刑事诉讼中案件当事人和社会公众的知情权,有必要构建较为完善的刑事诉讼涉案财物处置公开机制。目前,我国各地在公开返还涉案财物、公开涉案财物处理结果、涉案财物公开拍卖和涉案财物集中管理等方面都进行了积极的探索和实践,并取得了一定的成效。但仍然存在查封、扣押等侦查活动不规范、涉案财物处置信息化平台不健全、处置过程缺乏有关利害关系人的参与程序、处置信息不公开时的救济措施不完善等问题。对此,有必要对刑事诉讼涉案财物处置公开的内容予以界定。不同的诉讼环节、不同的公开对象应采取不同的公开方式,特别是在现代信息社会,要及时将涉案财物处置信息在网络平台公开,同时将拍卖信息在网上发布。司法机关应当主动公开涉案财物处置信息,对案件相关人申请公开的,有权机关应当对其予以审查并作出决定。为保护第三人财产利益,可以在庭审过程中就第三人财产权进行法庭调查和法庭辩论,或者建立专门的案外人财产权的听证程序。最后,应建立涉案财物集中管理与公开机制,建立刑事诉讼涉案财物的集中管理平台,对刑事诉讼涉案财物管理实行"单据移送、三家共管",以进行统一公开。
In order to garantee the acknowledgement rights of the parties and the public,it is necessary to build a more perfect criminal proceedings mechanism involving public property disposal. On the status of China’s current judicial point of view,the return of property involved in the public,public property involved in results,public property auctions and property involved in the centralized management and other aspects of the country have carried out active exploration and practice and achieved some results. However,there are some shortcomings,such as attachment,seizure and other investigative activities are not regular,the information platform is not perfect,it lacks of participatory processes for the interested parties,and the relief measures are not complete. In this regard,it is necessary to dispose the property,standardized methods and procedures involved in the disposal of public property,protection of the right to participate in the third person involved in the disposal of property,the property involved in the establishment of centralized management and disclosure mechanisms.
