摘要
随着国际工程承包业的迅速发展,工程规模不断增大,分包商成为项目执行不可或缺的主要角色。分包商处于工程项目产业链的最基层,是项目质量、进度、成本控制的直接实施者和第一道把关人,因此分包商的管理对于项目目标能否顺利实现至关重要。按分包形式将国际工程分包管理实践中的常见问题归纳为当地分包、国内分包和第三国分包,并展开分析。基于2011版FIDIC施工分包合同条件,对所归纳的问题分别从进度管理、质量管理、付款管理、变更索赔和争议解决等方面提出合同措施和解决建议。
With the rapid development of international contracting industry and larger scale of projects,subcontractors play an indispensable role.Subcontractor acts as the most basic level of the construction project management,as well as the implementer and first control of project quality,progress and cost.The problems in subcontracting are classifid into three categories:local subcontracting,domestic subcontracting and third country subcontracting,and are discussed individually in detail.The suggestions are put forward based on "FIDIC Subcontract Conditions for Construction(2011)" in terms of progress management,quality management,payment management,change,claims and disputes resolution.
