摘要
党的十八届四中全会通过的《关于全面推进依法治国若干重大问题的决定》将"坚持法治国家、法治政府、法治社会一体建设"规定在全面推进依法治国的总目标之中,凸显出"坚持法治国家、法治政府、法治社会一体建设"在全面推进依法治国方略中的核心价值与地位。2008年颁布的《企业国有资产法》对于国有资产经营管理法治化做出了许多创新性的规定,但该法的实施并非一帆风顺,存在着大量被虚置、误读,甚至规则相冲突的情况,折射出我国法治国家、法治政府、法治社会一体建设的困境。结合对《企业国有资产法》实施状况的分析,全面审视我国法治国家、法治政府、法治社会建设的基本状况,分析和探讨法治一体建设的基本路径,对我国"坚持法治国家、法治政府、法治社会一体建设"目标的实现具有理论价值和实践意义。
The Fourth Plenary Session of the 18 th CPC Central Committee passed The Chinese Communist Party Central Committee＇s Decision on a Number of Important Issues in Relation to Comprehensively Implementing Governing the Country by Law, put ＂insistence to the building of a country, a government and a society under the rule of law＂ into the ultimate goal of comprehensively implementing governing the country by law, and projected its value and role in the ultimate goal. Law of the People＇s Republic of China on the State-Owned Assets of Enterprises issued in 2008 has made a number of innovative regulations on the state-owned assets administrated by law, but there are also a lot of problems like the lack of efficacy and misinterpretations, which reflects the dilemma that the building of a country, a government and a society under the rule of law is in. This paper analyzes the implementation of Law of the People＇s Republic of China on the State-Owned Assets of Enterprises and probes the present situation of building a country, a government and a society under the rule of law, which will be of both theoretical and practical significance for the ultimate goal of CPC.
