教育法地位问题新论——传统法律部门理论的超越与反思 被引量:24

New Idea on the Status of Education Law——Transcendence and Reflection of the Traditional Legal Department Theory

摘要 教育法是否是独立的法律部门,是近年来教育法学研究的重要命题。传统法律部门理论导致教育法地位研究陷入困局。教育法独立说与隶属说都从一个侧面反映出教育法的基本特点,具有一定的合理性,但却不能完全反映教育法的基本性质。将教育法纳入综合法律部门,不仅是传统法律部门理论不断修正、适应新兴法律部门兴起与需要的结果,也是教育立法本身的特点与性质所决定的。超越传统法律部门理论,以教育法律问题为中心,才是教育法地位研究的价值与意义所在。淡化学科意识,坚持问题研究为中心,走向开放的教育法研究,应成为未来的重要取向。 Whether education law is an independent legal branch or not is an important topic in the study of educational law in recent years. Both the education law theory for independence and subordination reflect the fundamental features of the education law from the same perspective, but the chains of Chinese law theory more or less confine the academic development of the education law theory, which results in the problem that the basic nature of the education law cannot be fully revealed. Integrating the education law into the comprehensive legal department is not only the appeal of the intrinsic nature of the education law, but also the rectified result of the traditional legal department theory development to adjust itself to the rise and need of new legal branch. The research on the status of education law is supposed to break through the shackles of the theory of the traditional legal departments, insist on valuing the education issue, and improve the research in the basic theory of the education law. We should break through the boundary between subjects and maintain problem-centred research to serve the development of the education law as the research orientation in the future.
