摘要
网络空间国家主权存在是否具有正当性,是一个存在着激烈争论的问题,也是一个迫切需要解决的重大理论问题。事实上,不管在物理空间还是在网络空间,只要在一个国家内部作为政治统治工具的国家职能没有消亡,国家主权就不会消亡;而在国家外部,只要仍然存在着利益纷争和分歧,作为争取国家根本利益最高权威的国家主权就不会消失。这应该是颠扑不破的真理。可见,网络空间国家主权存在具有历史性、客观性、必然性和正当性。从网络治理角度来说,只有确认网络空间国家主权存在的正当性,国家主权和政治权威对网络虚拟社群进行规范、约束、纠治等的权威性治理才具备合法性和正当性。而在当前,影响网络空间国家主权存在正当性的主要因素是网络虚拟社群的无政府主义和自由主义思潮,其结果是对国家主权产生了剥蚀和聚合的双重作用。对其积极的聚合作用,应充分加以引导和利用;但对其消极的剥蚀作用,应采取合宜策略进行治理。
Whether there should be state sovereignty in cyberspace is a disputed problem as well as an important theory problem to be solved urgently. In fact,both in physical space and cyberspace,as long as the state function which is acted as a tool of political domination has not disappeared,the state sovereignty will not perish. Also,as long as there is still a conflict of interests and differences among countries in the world,the state sovereignty,which is performed as the highest authority of fundamental interests,will not disappear. This should be inconfutable truth. Therefore,the existence of state sovereignty in cyberspace has its historical objectivity,inevitability and legitimacy. From the perspective of governance the cyber space,only when the existence of state sovereignty in cyberspace is confirmed,the governance of state sovereignty and political authority which carry out the norms,constraints and rectifications to the virtual community has its legitimacy. At the present,the main factor that affects the legitimacy of state sovereignty in cyberspace is the non-governmental and liberal thoughts in the virtual community. As a result of this,the cyberspace community has double effects on state sovereignty and authority,that is,its negative effect of erosion and positive effect of polymerization. In this regard,the positive effect of polymerization should be fully guided and exerted,and the negative effect of erosion must be eliminated by taking appropriate strategies of governance.
