摘要
乡镇政府对村民委员会的指导权是一个既包括行政指导又包含行政协助的复杂行为。对于法律规定的村民自治事项,乡镇政府原则上不能指导,只有在村民自治会危害国家法制统一、损害基层群众合法权益、不利于社会稳定以及村民与村民委员会之间发生纠纷等情形下方可予以指导。同时,乡镇政府对村民委员会应当进行科学指导,即指导既要符合科学的指导理念,又要具备科学的指导方法。
With comprehensively deepening of the rule of law, a legal perspective of exploring the township government has important practical significance in guiding the villagers committee. The right to guide the villagers committee by the township government is a complex behavior of both administrative guidance and assistance. In principle, the township government has no right to guide villagers＇ autonomy matters prescribed by law. It is possible only when the villager autonomy does harm to the country＇s legal unity, the legitimate interests of the grassroots people, social stability and conflicts between villagers and the villagers committee. Meanwhile, the township government should give scientific guidance to the villagers committee according the scientific concept and scientific guidelines.
