摘要
在社会治理现代化和全面推进依法治国的背景下,劳资社会协商是解决劳资利益冲突的重要手段,应当从法律层面上推进劳资社会协商制度的发展。通过分析我国劳动关系领域社会协商存在的主要障碍,对于劳资社会协商法治化的推进,应着力于明确协商主体的法律地位、将劳资社会协商的必要手段法定化、构建劳动合同履行抗辩权制度、通过法律机制推动劳资社会协商制度的落实、建立实现劳资社会协商的法律救济制度。
In the context of modernizing social governance and comprehensively promoting the rule of law,social negotiation serves as a crucial method to solve the conflicts between employers and employees.The social negotiation system for employers and employees should be improved at the legal level.This article analyzes main obstacles to the social negotiation system in the labor relations area.It argues that the advancement of the legalization of social negotiation system for employers and employees should rely on the following aspects;further defining the legal status of negotiation parties;legalizing the essential elements of the social negotiation system;establishing the defense right of performance system in labor contracts;implementing the social negotiation system through the legal mechanism;and establishing the legal remedy system for the social negotiation system.
