摘要
GATS第6条第4款是WTO协定中涉及必要性检验的条款之一,其根本目的在于保证有关资格要求和程序、技术标准和许可要求的各项措施不致构成不必要的服务贸易壁垒,其中蕴含了必要性检验的要求。与WTO相关协定中涉及必要性检验的其他条款不同,第6条第4款本身没有规定具体的实体义务,而是授权工作组来制定关于资格要求和程序、技术标准和许可要求的多边规则。
As one of the important concepts of WTO covered agreements,the specific content of necessity test in GATS article 6（4）aims to ensure that relevant qualification requirements and procedures,technical standards and licensing requirements does not constitute unnecessary barriers to trade in services,and necessity test requirements are included.Different from other terms of WTO covered agreements concerning necessity test,the article 6（4）has no specific regulations about entity＇s obligations,but authorizes the working group to set out rules about qualification requirements and procedures,technical standards and licensing requirements.
