摘要
本文从分析介绍习近平总书记在从政经历的不同阶段逐步形成依宪治理思想的历史线索出发,较为全面和系统地梳理了习近平总书记依宪治理思想的理论来源、思想特征以及在党的十八大之后对以习近平为总书记的党中央作出全面推进依法治国的重大决策所产生的重大影响。作者以习近平总书记在首都各界纪念现行宪法正式施行30周年大会上的讲话、党的十八届三中全会《全面深化改革决定》和党的十八届四中全会《全面推进依法治国决定》等等重要文献为依托,详细分析了习近平依宪治理思想的重要特征及制度化要求,指出习近平依宪治理思想的最重要的理论价值是树立宪法至上的法律权威,其实践意义是推动宪法实施,使宪法作为根本法在实际中能够真正起到法律所应具有的调整人们行为、约束国家权力、保障公民权利的行为规则的作用。
On the basis of historical clue on the gradual forming of Xi Jinping＇ s thought on governance according to the Constitution at different phases, the author comprehensively and systematically summarizes the theoretical origin , characteristic of thought and important impact on important decisions made by the Centre of the Communist Party taking Xi Jinping as general secretary of the CPCCC concerning comprehensively moving governing the nation according to law forward by Xi Jinping＇ s thought on governance according to the Constitution. By means of analyzing such important materials as the speech made by Xi Jinping in the congress celebrating the 30th anniversary of implementation of the current Constitution on December 4,2012, the decision on comprehensively deepening the reform made in the 3ra Plenary Session of the 18th CPCCC and the decision on comprehensively moving governing the nation according to law made in the 4＇h Plenary Session of the 18th CPCCC, the author completely analyzes important characteristic and institutional request of Xi Jinping＇ s thought on governance according to the Constitution, and points out that the most important value in theory of Xi Jinping＇ s thought on governance according to the Constitution is to set up legal authority of constitutional supremacy , its practical meaning aims to promote constitutional enforcement and enable the Constitution to become the basic rule to handle individual＇ s behavior , control state power and protect right of the citizen.
