摘要
我国政府数据存取面临政府数据存取违法成本较低、政府对数据存取监管不力、公民对个人数据信息的保护意识缺乏、相关法律制度不完善等问题,可能导致对公民的隐私权、知情权和所有权的侵害。要有效解决这一问题,需从以下几方面着力:创新监管机制;提升公民个人数据信息保护的意识;建立民事、刑事救济机制;完善相关法律制度。
Current situation of government data access in China is challenged by such problems as low cost of law violation,weak governmental supervision,citizens＇ lack of protection consciousness for their personal information,and imperfect laws and regulations. These problems cause conflicts between government data access and the basic rights of citizens as they infringe the citizens＇ right of privacy,right to be informed,and ownership of their personal information. To solve these problems,we need to innovate the supervision mechanism,promote people＇s awareness of information protection,establish civil and criminal remedy mechanisms,and improve the laws and regulations in this field.
