摘要
多式联运是连接海上运输和陆上运输的运输方式,"一带一路"海陆运输通道建设为多式联运的发展提供了有利的契机。完善多式联运立法不仅是多式联运自身发展的重要保障,也是对"一带一路"战略的回应。我国现有多式联运立法存在着立法分散、制度缺失、适用范围局限及与国际实践脱轨等问题,考虑到"一带一路"战略下多式联运实践发展的现实需要以及我国立法的现有条件,应当制定一部以调整多式联运私法关系为主的统一规范,同时纳入对多式联运经营人准入和监管的公法性内容,为"一带一路"战略下海陆运输的发展提供法律支持。
Multimodal transport is an important transport form that links different means of transportation. New development of multimodal transport can be seen under "One Belt and One Road"strategy. A refined legal system can exert a positive effect to the development of multimodal transport,as well as make a response to the requirements from "One Belt and One Road"Strategy.However,current legal system of multimodal transport in China is uncoordinated and divorced from practice. Considering the needs of multimodal transport development under "One Belt and One Road"Strategy and existing legislative conditions,a unified multimodal transport law should be carried out. The unified multimodal transport law mainly contains private law relationships but also incorporates public law relationships,in order to provide sufficient legal protection of marine and inland transportation under "One Belt and One Road"Strategy.
