摘要
当前,我国新修订的《消费者权益保护法》对消费者撤回权制度的规定过于简单,缺乏操作性,导致这一制度在实际运行过程中存在保护对象受限、权利告知义务缺失、行使权利的规定模糊不清等问题。为进一步完善我国消费者撤回权制度,应适当扩大消费者撤回权制度的适用范围,明确告知义务,规范消费者撤回权的行使期限和行使方式,厘清法律后果,使该制度发挥更好的法律规范作用。
Provisions concerning consumers＇ right of withdrawal are far too simple in China＇s newly revised Law on Protection of the Rights and Interests of Consumers. The weak feasibility of such provisions results in problems such as limited protection,lack of information obligation,and equivocal statement on exercising the right. To improve provisions concerning consumer protection,we ought to expand the scope that the provision applies to,clarify traders＇ obligation to provide consumers with certain information,regulate the length of withdrawal period and the way to exercise the right,and give explicit statement about the legal consequences.
