摘要
我国未来竞技体育的全面职业化必然要求从法律上确定体育活动参与主体间的权利义务关系,教练员和运动员间的关系是其中的重要关系之一。然而,我们目前的体育法律对此缺乏规定,相比而言,英美法通过判例法比较明确地确定了教练员在体育训练和比赛过程中对运动员所负的注意义务,这些义务包括制定合理的训练计划,有效监管,维护训练和比赛环境安全,提供正确的指导,准确及时地评估运动员训练和比赛状态,确保运动员获得规定的工伤保险,制定及时有效的意外事故处置方案,确保运动员获得规定的工伤保险等,这些通过实践和内部规则确立的义务得到法院判例的确认,这些义务皆可以为我国未来制定运动员权益保护法提供参考。我国未来《体育法》的制定和完善需要强化对教练员和运动员权利义务规范的规定,同时,体育协会内部也需要建立较为详细的教练员行为规范,以对教练员的行为给予准确的规范和指导。
China's future comprehensive professionalization of competitive sports would necessarily require a clear definition,by law,of the inter-subject relationships of rights and obligations,one of which is the important relationship between the coach and the athletes. However,the current Chinese law lacks this kind of stipulation. In comparison,the common law,through case law,more clearly elaborates the coach's duty of care to the athletes in the process of sports training and competition,which includes a reasonable exercise plan,effective supervising,a safe competition environment,proper guidance,accurate and timely assessment of the state of the athletes' training and competition,a timely and effective accident disposal program,the required work insurance and other provisions. These obligations established by practice and internally developed rules,has been confirmed by jurisprudence in the common law system,which may be of value to China's future athletes protection law. China's future Sports Law should standardize the rights and obligations of coaches and athletes,while the sports associations also need to establish a more detailed code of conduct for coaches to better guide their behaviour.
