摘要
从生产安全事故调查处理工作实际出发,依据《生产安全事故报告和调查处理条例》(国务院令第493号)等相关规定,初步探讨了该条例的效力位阶和适用范围,并就实际事故调查中所涉及的事故调查主体、调查结论形成和事故调查报告的可诉性以及其作为事故类行政处罚的主要事实证据地位等问题进行了分析。在此基础上,提出笔者自己的观点,同时对该条例的修改完善提出自己的修改观点及建议。
From the practice of production safety accident investigation and handling work, the article prelimi- narily discusses the effect and applicable range of the rules according to production safety accident report and the investigation and handling rules, etc. The article further studies the accident investigation subject, the for- mation of investigation conclusion, suability of report of accident investigation and the main evidence status of administrative penalties in the practice. On the basis of this analysis, author puts forward views and gives the proposals to modify the regulations better.
