摘要
"立法者"一词用法甚多,归纳起来有抽象意义上的"立法者",如神、人民、主权者;有具体意义上的"立法者"。它作为组织有议会等立法机关,作为人又有两种:一种是法律制度的开创者,他们往往是伟大的政治家或贤哲;另一种是立法机关里工作的法学家,他们从事的是技术性的立法工作,完善和修订已有的法律制度。从历史上"立法者"一词的种种用法入手,在进行归纳和分析的基础上做一些思考。我们认为现实生活中的"立法者"应是具有素养的职业法学家,他们应该是了解人生和社会,理解法的精神,忠于法律事业和掌握法律技术的法律人。
term "legislator" can be used in many ways. Abstractly, legislators can be gods, or the people, or sovereigns. Specifically, a legislator can be an organization, such as the legislature or a particular person. As a legislator in person, he/she can either be a great politician or sage so that he/she can create a rechtssystem, or be a jurist of the legislature, engaging in technical legislation, amending and improving the existing laws. Starting from sorting out such usages of the term "legislator", this paper tries to rethink the term legislator through induction and deduction. This paper holds that a real legislator should be a professional jurist with relevant attainments,understanding life and society, apprehending the spirit of law, mastering legislature techniques and committing to the course of legislation.
