摘要
本文旨在说明自由放任的市场竞争可能导致劳动标准"竞次",并论证地方分权的市场化改革是中国地区之间产生劳动标准竞次的根源。为此,本文首先介绍了在山东R地货运行业调研的典型事例,继而通过长途货运与短途货运超限超载现状的对比,说明地方监管失灵是导致短途货运超限超载现象难以根除的根本原因。最后,本文分析地方监管失灵的原因,指出要从根本上杜绝劳动标准竞次,有发展同业公会、改革传统政绩考核方式和实行监管中央集权三种途径。
The purpose of this paper is to show that unregulated competition in a laissez-faire market may cause the race-to-the-bottom problem concerning labor standards,and that marketization in conjunction with regulatory decentralization is the root of the problem.For this purpose,we analyze the case concerning and out-of-gauge and overload transportation of freight industry in R Area,Shandong Province,and then illustrate that the failure of local regulation is the primary cause of overload transportation by comparing the status quo of out-of-gauge and overload in long-distance transportation and short-distance transportation.Then we introduce the causes of the failure in local regulation,and point out that in ovder to eliminate the race-to-the-bottom phenomenon concerning labor standards,China needs to reshape its regulation system and to recentralize its regulatory power.
