摘要
刑法作为维护正常社会次序的最后防线,在劳动者的职业健康权方面起到非常重要的作用,为更好地保护我国劳动者的职业健康权,该文列举我国当前职业病危害控制的现状,分析引起当前现状的原因,以及现行刑法对保护对劳动者职业健康权方面的不足之处,修改现行刑法立法以及相关司法解释是十分必要的,更有利于调节当前我国经济转型期在职业病防治方面的劳资矛盾。
Criminal law as maintaining normal social order of the last line of defiance, inoccupational and health of workers play a very important role, in order to better protect workers occupational health right, the article present situation of occupational disease hazardcontrol and the analysis of the causes of current situation, and the existing criminal law on the protection of laborers occupational and health aspects of deficiency, modify the current legislation of criminal law and relevant judicial explanation is very necessary, is moreadvantageous to adjust the current our country of economic transition in the area of occupational disease prevention and control of labor conflict.
