摘要
职业健康权是劳动者的法定权利,是健康权、生存权的重要组成部分。随着我国工业化和社会经济转型,劳动者的职业健康权受到挑战。刑法在立法和法律适用上对职业健康权的保护存在不足。只有完善刑法的有关规定,才能使劳动者的职业健康权得到有效保障。
The rights of occupational health are important legal rights of the labors.They are one of the core parts of the health rights of everyone.Along with the development of industry and the transformation of social economy in China,the occupational health rights of labors have faced great challenges.There are deficiencies in the protection of occupational health rights by criminal legislation and criminal justice.In order to strengthen the protection of the occupational health rights of the labors,the criminal legislation and justice should be proved.
