摘要
社区矫正的有效开展离不开先进的理念和健全的规范体系。当前,社区矫正的规范体系无论在完备性还是协调性方面,都存在明显的缺陷。其中,规范体系的不完备主要体现为《社区矫正法》的缺失,相关法规规章的不健全,以及其他规范性文件数量严重不足。规范体系的不协调则表现在对一些基本问题的规定或概念的使用上,不同的规范性(法)文件存在很大的差别。《社区矫正法(送审稿)》中虽然确立了"一个统一、两个结合"的矫正理念,但该理念并没有在该规范文本中得到贯彻,实践中也远未得到落实。为此,立法机关在通过《社区矫正法》时应该采取措施贯彻上述理念,矫正实践中也应该逐步改变重监管轻帮教的倾向。在改进社区矫正立法体系时,软法体系的建设同样应该得到重视。
The effective implementation of community correction is inseparable from advanced concepts and a sound standardized system. Currently, there are obvious flaws in terms of completeness and coordination of the standardized system of community correction. The incompleteness of the standardized system is mainly for the lack of ＂Community Correction Law＂, the imperfection of the relevant laws and regulations and a serious shortage of other standardized documents. The coordination of the standardized system is manifested in the use of some of the basic provisions or concepts; there is a big difference between the different standardized （law） files. Although the ＂Community Correction Law （draft）＂ established the correction concept of ＂one unity and two combinations＂, the concept has not been carried out in the standardized text and far from being implemented in the practice. To this end, the legislation organs should take action to implement the above concepts when passing the ＂Community Correction Law＂, and should also gradually change the tendency of more regulation than help and education in correction practice. When improving the legislation system of community correction, the construction of soft law system also deserves attention.
