摘要
合理使用制度需要平衡著作权人、传播者和使用者的利益,是对著作权人权利的一种限制。基于我国的基本国情和民族利益的考虑,合理使用应定性为使用者权利。《信息网络传播权保护条例》对合理使用限制太多,不利于作品的传播和国民经济的繁荣与发展。我们的法律制度不仅需求"国际接轨",而且还需要"中国特色"。
Fair use system,which is a restriction from the exclusive righet of the auther, needs to balance the interests of authors, communicators and users of works. Based on our fundamental national condition and national interests, fair use system should be reckoned as users＇ right.Regul- ation on the Protection of the Right to Network Dissemination of Information in which fair use is restricted too much is not helpful for communicating works or for prospering and developing nati- onal economy. Our national legal system is not only required to fall into with the international, but is in need of China＇s characteristics.
